Metro crane crash: HC rejects victims’ plea for damages

The Delhi High Court on Friday dismissed the petition filed by Shashi Dharan,who along with his family reportedly escaped death when a Metro crane crashed on to their car in May,against the DMRC.

The Delhi High Court on Friday dismissed the petition filed by Shashi Dharan,who along with his family reportedly escaped death when a Metro crane crashed on to their car in May,against the DMRC. Justice Rajiv Shakdher found several legal lacunae in Shashidharan’s petition,which has sought Rs 2 crore in damages from the DMRC for negligence. On May 9,a Metro crane weighing over 400 tonnes came crashing down on the Honda Civic car Dharan and his family were travelling in near Jor Bagh at Lodhi Colony. In his petition before the High Court,Dharan had contended that the safety of workers and people living near Metro projects were being compromised as the contractors did not get penalised for such accidents. Justice Rajiv Shakdher,however,noted that Dharan should have taken a different legal recourse for compensation,like filing a civil suit and/or getting an FIR registered in the incident.
