A Delhi court has asked seven persons, who are facing trial in a kidnapping case, to respond to a plea for cancellation of their bail on charges of assaulting a witness in the Saket court complex recently.
Jagat Singh Nagar and Parveen Nagar, along with five others, all of whom are accused of abducting and looting a driver in March 2010, allegedly assaulted a doctor, who was the owner of the vehicle and had come to depose as a witness.
Additional Sessions Judge Jitender Mishra issued a notice to the seven accused, asking them to appear before court on April 7, on the application filed by the Ramesh Sharma — the man who was kidnapped. Sharma sought cancellation of their bail.
Apart from Jagat and Parveen, others facing trial are — Nitin Nagar, Tarun Nagar, Jagir Singh, Krishna Pal and Vijender Singh — all residents of Delhi.
Sharma, in his plea, had alleged that a doctor, who is a material witness in the present case, was dragged outside the courtroom on March 1 and assaulted by the accused, with the help of some lawyers.
Sharma said the doctor was also threatened by the accused.
He said his lawyer was also assaulted and was asked to drop the case.
“He (advocate) was neither permitted to enter the courtroom, nor allowed to appear as a lawyer in court on my behalf,” Sharma said in his application.
“The accused persons, after securing bail, have misused their liberty, by assaulting physically the material witness (the doctor), thereby causing grievous hurt to him and the complainant’s lawyer Karan Chaudhary, to pressurise him and his witnesses to withdraw the case,” Sharma said.
The bail granted to the accused may kindly be cancelled, he said in his plea.
