A local court convicted a man of kidnaping, raping and illegally confining his 14-year-old neighbour.
According to the prosecution, the accused had taken the girl along, telling her he would take her to a mela. However, he fed her sweets laced with sedatives and took her to Jaipur on a bus. There he kept her locked in a room and raped her for a month.
The court of Additional Sessions Judge Virender Bhat convicted the accused, a resident of Najafgarh, of rape, unnatural sex, illegal confinement, kidnapping and threat.
Observing that it was immaterial that the girl did not raise the alarm during the course of her captivity, the court said it “cannot be construed to mean that she stayed willingly with the accused and was a consenting party to physical relations with him. It is also pertinent to note that the victim’s consent to sexual intercourse with the accused is also immaterial as she was less than 16 years of age when she was subjected to sexual intercourse by the accused”.
The incident dates back to April 12, 2012. On that day, the girl, a Class IX student, did not return home. In her testimony before the court, the girl said the man had met her on the way back and asked her to accompany him to the Surajkund mela. However, the girl said, on the bus, he fed her sweets, which made her fall unconscious. When she came to, they were on a different bus headed to Jaipur.
At Jaipur, the girl claimed, took her to a room which had no furniture, a cooler or a fan. The man told her he would take her home after a few days. However, from the next day, the girl claimed that he raped her and threatened her with a knife. He gagged her and tied her limbs before assaulting her daily, the girl said.
On May 8, the girl escaped when she found that the man had forgotten to lock the room. She borrowed a phone from a shopkeeper and informed her mother and brother, who rescued her. They also informed police. Sections of rape, illegal confinement, unnatural sex were added to the case of kidnapping registered earlier.
