Taking a stern view of the allegations of illegal constructions and encroachment adjacent to the 16th century Jama Masjid by the Shahi Imam and his brothers,the Delhi High Court on Thursday directed the authorities,including police and the Archaeological Survey of India (ASI) to stop disfiguration of the site near the monument by taking appropriate action.
How can this (construction) go on just adjacent to the Jama Masjid? Director General of the ASI,Deputy Commissioner of MCD (of the zone concerned) and DCP (Central District) are directed to look into the matter and stop the alleged construction, said Justice Vipin Sanghi.
Admitting a petition by one Suhail Ahmed Khan,a resident of the locality,the court also issued notices to Shahi Imam of the historical mosque,Maulana Syed Ahmed Bhukhari,and his three brothers,Syed Hasan Bhukhari,Syed Yahia Bhukhari and Syed Tarikh Bhukhari,and fixed the matter for hearing on July 17.
The court also called for an action-taken report from the authorities concerned. The petition has also impleaded the Central government and Delhi Wakf Board as parties.
In his petition,Khan alleged that the Shahi Imam and his brothers have been raising an illegal construction adjacent to a wall of the Jama Masjid in the Walled City. Khan also accused Bhukhari brothers of illegally encroaching area inside the mosque premises.
Besides encroachment in the surroundings of the Jama Masjid,the respondents no.1 to 4 (Bhukharis) in connivance with each other has recently started raising constructions just adjacent to the historical mosque, read the petition.
The Imam and his brothers have also occupied substantial portions of the mosque,it said,adding that the civic bodies and others concerned have failed to take any action against the alleged illegal construction.
