Delhi Police has lodged an FIR against Hero MotoCorp and its executive chairman Pawan Munjal for alleged cheating, forging and manufacturing of bills worth Rs 5.9 crore. Police said the offence took place in 2009-10 even as the complainant, Brains Logistics Pvt Ltd, filed a complaint in the matter on October 5.
Police said a case has been registered against the company, Munjal and other senior officers at the firm.
In the FIR, the complainant, a service provider based in Delhi, alleged that the accused committed “illegal acts of forgery, cheating and falsifying the books of accounts”. The FIR further said that the accused, in collusion with each other, manufactured fake month-wise bills of a total of Rs 5.94 crore in 2009-10. The bills are signed and have a stamp of ‘Hero MotoCorp Ltd’, said police.
Police said the accused obtained a false CENVAT (Service Tax) credit of more than Rs 55 lakh against the fake bills and cheated the Income Tax Department along with the complainant.
According to the FIR, along with Munjal, Vikram Sitaram Kasbekar, Hari Gupta and Manjula Banerji — all employees of Hero MotoCorp —have been named. The complainant said they later ended their contract with the company.
“The month-wise fake bills were dishonestly fabricated… and used by the accused herein as genuine month-wise bills before the statutory authorities, regulatory authorities as well as judicial and non-judicial forums and the accused company and it obtained false CENVAT (Service Tax) credit of Rs 55,51,777/- against the fake bills and cheated the Income Tax Department… Further, the accused company created false debit balance of total Rs. 5,94,52.525/- against the complainant company by falsifying its books of accounts of the year 2009 and 2010 herein and cheated the complainant company,” reads the FIR.
Police said they are conducting an enquiry into the matter. The accused have been booked under IPC sections pertaining to forgery, falsification of accounts, criminal conspiracy, and criminal breach of trust, among others.
Hero MotoCorp released a statement saying: “It is an old matter pertaining to the year 2009-10 with a disgruntled service provider, Brains Logistics Pvt. Ltd. (Promoter-Roop Darshan Pandey)… In 2013, Hero MotoCorp also registered an FIR against them and the matter is ongoing before the competent court.”
