Father gets 10 years in prison for raping, sodomising daughter

Girl's parents were factory labourers and used to work in separate shifts.

A city court has sentenced the father of a 10-year-old to life imprisonment for raping and sodomising his daughter. The matter was reported last year when the girl’s teacher,a NGO worker, chanced upon the injury marks on the girl. The girl told her teacher that her father,in the absence of her mother, used to beat, rape and sodomise her.

According to the prosecution, the girl’s parents were factory labourers and used to work in separate shifts. The father generally worked day shifts. However,on days when he had a night shift,he stayed at home the following day and raped his daughter while his wife was at work.

Her father also threatened her against saying anything to her mother. The mother told the court that she did not know anything about these incidents as the victim was asleep by the time she got back home from her 12-hour shift.

After the girl’s mother was informed, the woman filed a complaint against her husband at Adarsh Nagar police station. In the court, the defence claimed that the child had testified to sexual abuse after being tutored by her mother. However, the court dismissed the arguments in the light of incriminating medical reports and circumstantial evidence. On November 28,Additional Sessions Judge Illa Rawat convicted the girl’s father on charges of rape and sodomy.

The father prayed for leniency while awarding of punishment but the judge refused to show any.

“Despite the fact that the child was a pillar of strength for her parents, the convict, instead of showing his love and affection to the child, sexually abused her… the testimony of the child clearly brings out her plight and agony. The acts of the convict would never have been reported, had it not been for the intervention by NGO members… due to the acts of the convict, the victim is now living the life of an orphan in a children’s home and even her mother does not want her,” the judge said.

She awarded a compensation of Rs 2 lakh to the girl.
