Meanwhile, a Delhi court has extended Aaftab Poonawala’s police custody by four more days in the Shraddha Walkar murder case. A court on Tuesday gave Delhi Police permission to conduct a polygraph test on Aaftab Amin Poonawala. Delhi Police had moved it application in court on Monday.

Jail video leak: 'Not a single leak from ED', says counsel

At the first hearing of the leaked video case wherein AAP leader Satyender Jain can be purportedly seen getting a massage, ED counsel Zoheb Hassan told special judge Vikas Dhull: "There is not a single leak from ED. We are concerned with impartial investigation." 

"We had it (video) for 14 days. The moment they got the copy, a day later there was a leak. Once the bail was decided and it was rejected, moment that happens everything is been diverted through a complete non issue," he said.

Jain's lawyer, senior advocate Rahul Mehra to court, "The ED reply to the application has first been leaked to the media. Everything is playing on all national channels..this has been leaked by Jain ? Either he is a magician that he gets everything ED has. They can say anything they want..they can circumvent what is visible and negate everything just because they are ED."

Mehra prays for an order fixing responsibility for any further leaks to the ED. 

"Therefore every single minute or delay is prejudicing the accused in this case. Kindly pass an order," Mehra said.

HC seeks LG's stand on DDCD vice chairman Jasmine Shah's plea against sealing office

The Delhi High Court on Tuesday sought the stand of the lieutenant governor on the Delhi government think tank DDCD's vice chairman Jasmine Shah's challenge to the order restraining him from discharging his duties and sealing his office.

Justice Yashwant Varma listed the case for further consideration on November 28 and asked the counsel appearing for the LG and other respondents to make submissions on that date.

Bearing in mind the question which arises, let the standing counsel appearing for respondents obtain instructions, the judge said.

Shah has challenged the November 17 order issued by Director (Planning), Delhi government, on the LG's request to Chief Minister Arvind Kejriwal to remove him from the post of vice chairperson of the Dialogue and Development Commission of Delhi (DDCD), and pending such a decision, to restrain him from using his office space and withdraw the staff and facilities assigned to him. Gurgaon police on patrol duty roughed by men at DJ party, one officer injured

Two policemen who had gone to check a complaint of blaring music at a DJ party were allegedly roughed up by three men on Monday night in Gurgaon, police said. One policeman suffered a head injury and was rushed to a hospital. The accused are yet to be arrested, said police.

According to the police, constable Bhupender and special police officer (SPO) Ranbir who were on patrol duty in the Badshahpur area received a call from the police station following a complaint that a disk jockey (DJ) was playing music loud at Fazilpur Dhani in sector 72. Read more

Delhi Police get court permission to conduct polygraph test on Poonawala

A court on Tuesday gave Delhi Police permission to conduct a polygraph test on Aaftab Amin Poonawala. who allegedly killed and dismembered the body of his live-in partner Shraddha Walkar, police sources said on Tuesday. Delhi Police had moved it application in court on Monday.

"Yes. We have received permission from the Delhi Court to conduct a polygraph test on Poonawala," a police official told PTI.

A polygraph test is a non-invasive technique in which no medicine is used. The subject is attached to a machine and questions are asked to him/her about the matter related to any case or incident. The variation in the graph when the subject answers the questions are mapped to draw a conclusion. (PTI)

Man giving massage to Satyendar Jain not physio, but prisoner in rape case: Tihar jail sources

The explanation given by the AAP on a viral video of jailed Delhi minister Satyendar Jain as “physiotherapy, not massage” has taken a new turn with Tihar Jail sources alleging that the masseur seen massaging Jain is not a physiotherapist, but a “prisoner in a rape case”.

Official sources at the Tihar jail said, “The masseur providing massage to Satyendra Jain is one prisoner Rinku S/o Tarachand. He is a prisoner in a rape case, charged under section 6 of POCSO and 376, 506 & 509 of IPC.” Rinku is not a physiotherapist, sources said, adding that the case (FIR No. 121/2021) pertaining to his crime was lodged at JP Kalan police station.

Kejriwal should apologise to nation, dismiss Jain: BJP on massage video

The BJP demanded on Tuesday that Delhi Chief Minister Arvind Kejriwal should apologise to the nation and dismiss his jailed minister Satyendar Jain over fresh allegations related to a massage video. The tirade came after sources claimed that the masseur, who was seen in video footage giving a massage to Jain, was not a physiotherapist, but an inmate who is lodged in the Tihar Jail in a rape case.

The Aam Aadmi Party, which received flak over the videos, had asserted earlier that Jain was receiving physiotherapy in the jail, where he is in judicial custody for the past five months over money-laundering charges.

At a press conference around afternoon, BJP spokesperson Gaurav Bhatia dared Kejriwal to respond to the fresh allegations "within an hour". He termed the AAP an "'arajak aparadhi' party (anarchist criminal party)", accusing it of defending the wrongdoing in the jail. (PTI)

Delhi HC dismisses plea seeking transfer of Shraddha walkar murder case to CBI

The Delhi High Court has dismissed with costs a public interest litigation seeking the transfer of the investigation into the Shraddha Walkar murder case to the CBI.

A division bench of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad asked advocate Joginder Tuli, who was appearing for the petitioner, “Tell us one good reason for transferring the matter… The parents don't have any grievance. You are a stranger”. 

Tuli had contended that the probe was not being conducted in a proper manner. Santosh Tripathi, appearing for the state of Delhi, said that plea should be dismissed with costs as baseless allegations had been levelled against the police. Sanjay Lao appearing for the Delhi police said that “so many comments have been levelled against the Delhi Police” without any basis. 

Tuli said that if Narco and polygraph tests are being conducted, then the same should be submitted to the court. “They should inform the court what they have done so far,” Tuli said. The bench responded to this saying that the court is not a monitoring agency.

At this point, Lao submitted that around 200 police personnel were investigating the case, including the Additional CP and Cyber Cell ACP. “Around 80 per cent of the investigation is complete.”

Delhi HC dismisses Future Group's please seeking termination of arbitration proceedings initiated by Amazon

A single-judge bench of Justice C Hari Shankar of the Delhi High Court has dismissed the Future Group's plea seeking termination of the arbitration proceedings initiated by Amazon before the Singapore International Arbitration Centre (SIAC). 

Justice Shankar said that he has not expressed any opinion on the merits of the arguments raised by the parties and the arbitration before the SIAC will continue.

The issue dates back to 2020 when Amazon approached the SIAC arguing that the Future Group’s deal with the Mukesh Ambani-led Reliance Retail was a violation of their contract. The SIAC subsequently put the Future-Reliance deal on hold.

The Delhi High Court — in its October 29 verdict last year — said it will not interfere with SIAC’s order on the Rs 24,713 crore merger deal. Previously, the High Court had on February 2 directed that status quo be maintained concerning the merger deal, and on March 18, it attached the properties of Future Group promoter Kishore Biyani and other officials linked to the company.

Delhi court extends Aaftab Poonawala’s police custody for 4 more days

A Delhi court on Tuesday sent Aaftab Poonawala to four more days of police custody in connection with the murder of his live-in partner Shraddha Walkar.

Poonawala has been accused of chopping the 27-year-old woman’s body into more than 30 parts and disposing them of across several areas of the city over two-three months.

Poonawala was produced before a metropolitan magistrate through video conferencing, his lawyer said, and the hearing took place before the designated time, keeping in consideration Poonawala’s safety. Read more

Satyendar Jain has lost 28 kg since being jailed: Lawyers to court

AAP leader Satyendar Jain’s lawyers have moved a Delhi court alleging that Tihar jail authorities have stopped providing him food items as per his religious beliefs.

The application was moved on Monday before a special judge at Rouse Avenue court.

His lawyers submitted that since Jain is unable to visit a temple as per his religious beliefs, he has been on a fast and is not having cooked food, pulses, grains and milk products. (Read more)

Delhi nursery admission process for 2023 to start from December 1

The application process for admissions at entry level classes in Delhi’s private school’s will begin on December 1.

The admission process for these entry level seats is starting two weeks earlier than it did last year.

According to the schedule released by the Delhi government’s Directorate of Education, all private schools will have to upload their admission criteria by November 28 and the application process will begin on December 1. The last date of submitting applications will be December 23. The first list of selected candidates and the waiting list will be issued by schools on January 20. Following this, the second list, if any, will be issued on February 2, and any subsequent list on March 1. The admission process will close on March 17. (Read more)

Amid Satyendar Jain ‘massage video’ row, Kejriwal recalls Amit Shah’s time in jail

Following the BJP’s attack over CCTV footage showing AAP minister Satyendar Jain getting a massage in his prison cell, Delhi Chief Minister and party chief Arvind Kejriwal said the minister was receiving “physiotherapy”, as suggested by his doctors.

Penile construction surgery in Delhi helps 34-year-old UP resident complete transition to man

Doctors at Delhi’s Sir Ganga Ram Hospital have successfully completed a phalloplasty – or penile construction surgery – on a 34-year-old patient with gender dysphoria, hospital officials said.

The Uttar Pradesh resident has over the past six years transitioned from female to male, having been put on male hormone replacement therapy since 2016, undergoing bilateral breast removal in 2017, as well as uterus, ovary and vaginal removal in 2019, the hospital said.

“At the time of arrival at Sir Ganga Ram Hospital, the patient had all male characteristics including beard, hair on chest, male voice and male behaviour. The only remaining requirement was penile reconstruction (phalloplasty),” the statement said. Hospital authorities also shared that the patient is now married to a woman he has known since childhood. Woman’s body in red suitcase: Police say father killed her over going out

Police in Mathura, after questioning the father of a 21-year-old woman whose body was found inside a red suitcase on the Yamuna Expressway last week, have concluded that he killed her because she left home for a few days without informing the family.

While police were initially clueless about who she was, and had formed five teams to look for clues, they made a breakthrough when her mother and brother came forward to identify her based on photographs circulated of the woman. She was identified as Ayushi Yadav, a student of Bachelor of Computer Applications.

Police had earlier said the woman had what appeared to be a head injury and a wound on the shoulder. They had said an autopsy will make it clearer what led to the death. (Read more)

Excise case: Delhi HC tells 5 channels to air reports ‘in tune with’ CBI, ED releases after Vijay Nair claims info leak

The Delhi High Court on Monday directed five TV news channels to ensure that all broadcasts on the excise scam case are in “tune with the official press releases” issued by central investigative agencies and “comply with the directives which govern them”.

A single-judge bench of Justice Yashwant Varma issued notices to five TV news channels and directed the National Broadcasting and Digital Standards Authority (NBDSA) to “duly examine the broadcasts and tell the court whether they have complied with their guidelines” or not.

The directions were passed on a plea filed by AAP communication in-charge Vijay Nair, an accused in the case, who alleged that the Central Bureau of Investigation and the Enforcement Directorate had leaked sensitive information to the media. Nair contended that the alleged leak had prejudiced his rights in the case. (Read more)

Delhi HC to news channels: Broadcast liquor scam news based on official press releases

The Delhi High Court has directed news channels to ensure that all broadcasts carried in respect of Delhi liquor scam case are based on official press releases and communications issued by the CBI and the ED in compliance with directives which govern them. 

The direction was made in a plea moved by AAP communications incharge Vijay Nair alleging that the central agencies had leaked sensitive information to the media.

While hearing the plea, Justice Yashwant Varma further directed the News Broadcasters and Digital Standards Authority to examine the impugned broadcasts and tell the court whether the channels have complied with the guidelines.

BJP releases purported sting video to claim AAP selling ticket for MCD polls

The BJP on Monday released a sting video shot purportedly by a former Aam Aadmi Party volunteer from north west Delhi’s Rohini to allege the AAP was selling tickets for MCD polls.

No immediate reaction was available from the AAP over the BJP charges.

The AAP and its chief Arvind Kejriwal are deeply involved in corruption, BJP national spokesperson Sambit Patra alleged at a press conference here, playing the purported sting video. Read more.

Gurugram collapse: SC issues notice to Chintels India, asks how structure built recently came down collapsing

The Supreme Court on Monday agreed to hear the plea of residents of Gurugram's Chintels Paradiso society, a part of which collapsed in February killing two women, seeking compensation and action against the developer. A bench of Justices K M Jospeh and Hrishikesh Roy issued notice to Chintels India Private Limited and sought its reply on the plea filed by the residents.

"If you look at your advertisement, it says it is a lush green and beautiful apartment. But its beautiful only in the picture not in reality. How come a structure which was built so recently came down collapsing like this? It is very serious issue. We will issue notice," the bench said.

Advocate Prashant Bhushan, appearing for the resident petitioners of Chintels Paradiso society in Sector 109 of Gurugram, submitted that the audit of the structures reveals that the building in unsafe.

He said the residents have been asked to vacate all the towers so the builder should pay the rent. The counsel appearing for the builder told the court that an inspection by IIT is going on and the expenses are being borne by it.

The matter will now be considered by the bench on January 6, 2023.

Earlier in February, ceilings of several flats in one of the towers in the complex collapsed resulting in the death of two.

After the partial collapse in Tower D, the Department of Town and Country Planning (DTCP) had ordered a structural audit of the affected towers. A Special Investigation Team headed by the additional deputy commissioner was also formed to probe the incident.

The authorities, after structural audits, have recommended the demolition of the tower in question and the evacuation of neighbouring towers. PTI

Two days after a young woman’s body was found wrapped in a polythene bag and stuffed in a red suitcase along the Yamuna Expressway, the Mathura police identified the deceased. The brother and mother of the deceased identified the body, police said, adding they are residents of Delhi’s Badarpur. Police had dispatched teams to the neighbouring districts in UP and were examining CCTV footage and call records. Posters were also put up and the matter widely publicised on social media.

Nearly two months after the Delhi Police solved the robbery case of a jewellery consignment worth Rs 4-6 crore and nabbed four men involved in the crime, the proprietor of the courier company who was handling the consignment has moved court alleging a senior officer is not releasing the recovered items. On August 31, two courier company executives were waylaid in Central Delhi’s Paharganj by four miscreants who threw chilli powder into their eyes and decamped with their consignment. The complainants were carrying two bags and a box filled with diamond, gold and silver jewellery. Police had said the accused posed as policemen and stopped them on the pretext of frisking them. Nearly 24 hours after the incident, police caught the accused from Jaipur.

Kejriwal conducted a ‘jan samvad’ in Paharganj on Sunday morning. In his address, he said he is confident that the Aam Aadmi Party would gain control of the Municipal Corporation of Delhi and that “it’s just a question of how many seats”.'

“There’s going to be an AAP government in the MCD. It’s just a question of how many seats… We want 230 out of 250. We have got the Delhi government, we are going to form the MCD government. So we will work for Delhi. If you, even by mistake, make a BJP candidate win from your locality, all work will stop there. Because they will fight with us, do dharnas against me… Do you want this for the next five years? You want work to be done? Toh upar bhi humaari sarkaar hai, neeche bhi humaari sarkaar hai. Kaam toh Kejriwal hi karega,” he said, adding “Don’t vote for those who stop work, vote for those who work.”

Meanwhile, BJP's JP Nadda said, people who talk about schools are now steeped in corruption and involved in a liquor scam. He said so at an MCD poll rally in Sangam Vihar and asked voters to “teach the Delhi government a lesson”.

Nadda referred to the AAP’s “scams” and “corruption”, pointing to the excise policy, a video of AAP Minister Satyendar Jain receiving a ‘massage’ in Tihar jail, and its failure to deal with garbage despite receiving funds from the Centre.

“The victory (of the BJP) will not be a victory of the candidates, but a victory of people’s rights. Dilli sarkar, jo upar se neeche tak bhrashtachar mein doobi hui hain… it has tried to strangle even the municipal corporation and do injustice to the people of Delhi. The chance to teach such people a lesson comes in the elections,” Nadda said.

In other updates: With searches continuing in Delhi and Gurgaon to find Shraddha Walkar’s remains, who was killed and her body chopped into multiple pieces allegedly by her live-in partner Aaftab Poonawala, Delhi Police Sunday recovered bones, one of which appears to be a part of a skull, from different forest areas. The same will be sent for forensic examination to verify if they are human, said police.

Police are also pumping out water from a lake in Maidangarhi as it is suspected that Poonawala allegedly threw body parts into it.

Delhi LG VK Saxena on Monday approved the filing of a review petition in the Supreme Court against its decision of acquitting three accused, who were earlier convicted and awarded death sentence by the trial court and Delhi High Court, in the rape and murder of a 19-year-old girl on February 9, 2012 at Chhawla, Dwarka, Delhi. According to a source, VK Saxena has also approved the appointment of Tushar Mehta, Solicitor General and Aishwariya Bhati, Additional SG, to represent the case before the Apex Court.

A practising lawyer has moved a plea before the Delhi High Court seeking transfer of investigation into the Shraddha Walker murder case from Delhi Police to the CBI. The plea states that investigation by Delhi Police, in this case, can't be efficiently carried out due to administrative/staff paucity and lack of sufficient technical and scientific equipment to find evidence and witnesses as incident occurred about six months ago. The PIL states that every minute and sensitive detail about the investigation has been revealed to the media and their presence at places of recoveries, court proceedings amount to interference with evidence and witnesses.

In other news, a Delhi court will hear on Monday a plea moved by jailed AAP minister Satyendar Jain seeking contempt proceedings against the Enforcement Directorate (ED) for allegedly leaking CCTV footage to media, reported PTI. Special Judge Vikas Dhull on Saturday directed the agency to file its response on Jain's plea, accusing the ED of leaking the CCTV footage purportedly showing the politician getting a massage inside the Tihar jail "despite an undertaking given in the court".

A social media influencer died and two of his friends were injured in a car crash in Greater Noida in the early hours of Monday morning. Police identified the deceased as Rohit Bhati, also known as Rowdy Bhati, a native of Bulandshahr, while his injured friends were identified as Manoj and Aatish. The incident took place near the Chuharpur underpass when the car struck a tree at around 3 am, under the jurisdiction of the Beta-2 police station. Police suspect the likely cause was that they lost control of the vehicle while taking a turn.

With just two weeks to go for the Municipal Corporation of Delhi elections, the BJP has pulled in about 5,000 leaders from across the country to woo voters in the national capital, keeping in mind the linguistic diversity in different wards. The influx, though, has led to some heartburn among local leaders, it is learnt. While BJP’s Chief Ministers and MPs being roped in has made headlines, the party has also reached out to unit presidents, zila adhyakshs (district presidents) and paarshads (councillors) from other states to lend heft to its campaign in Delhi.

Delhi BJP president Adesh Gupta Monday suspended about 11 party members for six years for “indiscipline”, after they decided to independently contest against official candidates fielded by the party for the MCD polls. These suspended members, one of whom is a former councillor, filed their nominations independently after the BJP denied them tickets for the polls.
