Delhi News Live Updates: Court discharges 11 men in murder case, calls them 'sympathisers' in Delhi riots case

A Delhi court has discharged 11 men accused for the murder of an auto driver during the February 2020 riots observing they had no role in the crime and were in fact "sympathisers for the victim".

Additional sessions judge Pulastya Pramachala made the prima facie observation based on statements of the witnesses and the video of the incident in an order passed on March 18.

"The statements of the witnesses and the video of the incident show that the members of the mob of persons from Muslim community had no role to play in the beating of victim Babbu. Rather they were sympathisers for this victim,” the judge said.

The court, however, ordered framing of the charge of murder and other offences against eight men from a different community, saying they assaulted and left the injured victim on the road following which "rival mob, including those being discharged, came to that boy" and perhaps took him from the spot. 2020 Delhi riots: Delhi court charges 8 with auto-rickshaw driver’s murder, discharges 11

A Delhi court has framed charges against eight men for the death of an auto-rickshaw driver during the 2020 Delhi riots, and acquitted 11 other accused due to lack of evidence.

In an order dated March 18, the court framed the charges against the eight men in connection with the case noting that there was prima facie evidence to proceed against them under Sections 148 (rioting with a deadly weapon), 153-A (promoting enmity between groups), 302 read with 149 (murder committed by unlawful assembly) among others of the Indian Penal Code (IPC).

“Videos showed that when the persons assaulting that boy (Babbu) left him on the road in injured condition, the persons from the rival mob came to that boy and probably they lifted him away from that place. So, by no stretch of the imagination, it could be part of the common object of the mob of persons from the Muslim community to assault the victim namely Babbu,” Additional Sessions Judge Pulastya Pramachala of Karkardooma Court said in his order.

Delhi Assembly Speaker tightens screws on bureaucracy, asks chief secretary to ensure officers’ availability for new MLAs

In what is being seen as a “cautionary message” to the capital’s bureaucracy, Delhi Legislative Assembly Speaker Vijender Gupta Wednesday wrote to Chief Secretary Dharmendra about how heads of government departments under them should deal with newly-elected legislators. The bureaucracy in Delhi was usually seen at odds with the previous Aam Aadmi Party (AAP) government.

Terming it “a serious matter”, Gupta cited instances where senior bureaucrats at the helm of Delhi government departments were not making themselves available for communication with MLAs. The BJP dethroned the AAP at the helm in Delhi, winning 48 of the 70 seats in the recent Assembly election.

“A few instances have been brought to my notice where the communications of the Hon’ble Members in the form of letters, phone calls or messages have not even been acknowledged by the concerned Officer,” Gupta wrote.

The court has issued the stay in a petition moved by Delhi Amateur Boxing Association (DABA), the state association for boxing in Delhi, that challenged the circular. DABA has termed the circular illegal, arbitrary, and unconstitutional.
