PIL in HC against ‘unauthorised construction’ in Delhi’s Sainik Farms, litigant asked to implead owners

Hearing a public interest litigation alleging unauthorised construction in South Delhi’s Sainik Farms, Delhi High Court Wednesday asked the litigant to show how the court can pass orders without hearing the property owners.

A division bench of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad granted time to the PIL petitioner Manav Janhit Vikas Sanstha to implead the owners of the properties, which according to him, have been constructed illegally.

Hearing the petitioner, the High Court said, “You want us to pass an order to demolish the properties without hearing the parties? You should implead the persons whose properties are mentioned in the petition.”

When the petitioner’s counsel said that he does not have any information about the owners of the properties and it would be difficult for him to identify the persons, the court said, “It would be very difficult for us to pass orders behind someone’s back,” asking the counsel to do “some homework”.

The petitioner’s counsel sought some time to implead all those persons whose properties have been mentioned in the plea, pursuant to which the court listed the matter for July 24.

The plea contends that the petitioner organisation had noticed that “illegal and unauthorised constructions are being carried out in sainik farms” despite the fact that any kind of repairing borewell cutting of trees or any kind of construction in Sainik Farm has been stayed by previous orders of the High Court. The plea gives a list of seven houses where alleged unauthorised constructions are being carried out “without name plates”.

The plea claims that the petitioner made representations in February to the LG, MCD, District magistrate South District, DCP South but the construction did not stop and no action was taken. It alleges that representations were followed by “personal visits” made to the officials of the MCD.

The plea claims that the “officials concerned of the MCD are in massive collusion and connivance with the persons carrying illegal constructions because no action whatsoever has been taken by them against the unauthorised construction”.

The plea prays for direction to the MCD, SHO police station Neb sarai and the Residents Welfare Association to take immediate action under the Delhi Municipal Corporation Act.
