Delhi HC to transfer ANI’s copyright infringement suit against YouTuber to itself from district court

ANI had filed a copyright and trademark infringement lawsuit against YouTuber Mohak Mangal before the Patiala House Court in Delhi.

The Delhi High Court Friday indicated it would direct the transfer of a trademark and copyright infringement suit by news agency ANI against YouTuber Mohak Mangal from a district court in the city to itself.

Justice Manmeet Pritam Singh Arora made the oral observation after hearing both parties and added that the court would pass an order accordingly. “I don’t see the point of two (different) courts trying the same issue… I’ll allow the petition, I’ll pass the orders,” said Justice Arora.

ANI had filed a copyright and trademark infringement suit against Mangal before a Patiala House court of Delhi, and had filed another defamation and disparagement suit against him before the Delhi HC in June and May, respectively.

Mangal then moved the Delhi HC, seeking ANI’s suit accusing him of trademark and copyright infringement before the Patiala House court be transferred to the high court instead, saying there are overlapping issues in the two suits. Mangal has also argued that the validity of copyright strikes issued by YouTube, too, needs to be tested.

An owner can submit a legal copyright removal request, also known as a takedown notice, to YouTube for using copyright-protected content unauthorisedly. YouTube then reviews such requests, and if they are found to be valid, the Google-owned company takes down the alleged copyright-infringing video, which is known as a copyright strike.

In its copyright infringement suit before the Patiala House court, ANI accused Mangal of infringement of its protected exclusive content in at least 10 videos. As of this date, all 10 videos appear to have been taken down or are no longer available for viewing.
