Delhi HC gives Centre 7 weeks to follow order on HRA benefit for all CAPFs

The Delhi High Court has granted seven weeks to the Centre and other authorities to comply with a division bench’s order in December 2022, which said house rent allowance (HRA) will be given to not only Personnel Below Officer Rank but to all personnel of paramilitary forces, irrespective of rank, as per their entitlement.

In its December 2022 order, a division bench of the HC had observed that the Centre and other authorities cannot be permitted to take a discriminatory view on “personnel of different forces deployed in common areas for grant of HRA”. It had directed the Centre and other authorities to take a decision on extending House Rent Allowance to “all” paramilitary personnel within six weeks.

In an August 29 order, a single-judge bench of Justice Jasmeet Singh observed that the authorities were directed to comply with the December 16, 2022 order of the division bench within a period of six weeks. But more than nine months since, the order has not been complied with.

“Time and again it is coming to notice of this court that timelines and directions given by this court are totally ignored and not adhered to. The mere fact that an SLP is filed is no reason for noncompliance of the order,” Justice Singh said in his order last month.

The court observed that the CRPF is a security force and is not exempt from the jurisdiction of the HC. It said there had been “total non-compliance” of the directions and timelines indicated by the court.

“At the request of Harish Vaidyanathan Shankar, learned CGSC [Central Government Standing Counsel], a period of 7 weeks is granted to comply with the judgement dated 16.12.2022,” the HC said.

The court listed the matter next on November 23.

The order was passed in a plea seeking initiation of contempt proceedings against the authorities for violating the December 16, 2022 order
