Delhi Court issues conditional stay on attachment of Bikaner House

The court had, on September 18, directed the attachment of Bikaner House, after the arbitral award of Rs 50.31 lakh to the company, Enviro Infra Engineers Private Limited was not paid.

A Delhi Court Friday granted a conditional stay on the attachment of Delhi’s Bikaner House owned by Nokha Municipal Council of Rajasthan. The court, however, directed the civic body to deposit within two weeks an arbitral award of Rs 50.31 lakh that it owes a company.

“Considering the overall facts and circumstances of the case and keeping in view the submissions made on behalf of both the sides, as also the submissions made on behalf of JD (Nokha Municipal Council in Rajasthan) that it is willing to deposit the decree amount in the court, further proceedings pursuant to warrants of attachment executed in respect of said immovable property, i.e., Bikaner House is kept in abeyance till disposal of such objections,” said Vidya Prakash, District Judge (Commercial), in her order Friday.
