Delhi court acts against SHO of Vikaspuri for not lodging FIR despite order

When the case was heard next on September 3, the SHO had not registered a case against the firm and was issued a showcause notice

A Delhi court on Monday initiated a case against the Vikaspuri Station House Officer (SHO) for not lodging an FIR against a private firm — hired by the Municipal Corporation of Delhi (MCD) — for allegedly picking up a man’s 15-year-old car parked in Vikaspuri. This was despite the court ordering that a case be registered.

“…SHO PS Vikas Puri has not filed any reply to show cause notice which was duly served upon him nor he or the APP (Assistant Public Prosecutor) representing him has given any reasonable reply/justification regarding the circumstances under which SHO PS Vikas Puri has failed to register the FIR…within the stipulated time period of 24 hours from the time of receipt of orders,” said Judicial Magistrate of First Class (JMFC) Rishabh Kapoor of Dwarka Court.

“…this court is left with no option but to take recourse to the provision of Section 379 r/w 215 of BNSS for commission of offence u/s 223 BNS (disobedience to order duly promulgated by public servant) by Inspector Rajveer Singh for deliberate and willful non compliance of directions … issued by this court,” JMFC Kapoor added.

The court was initially hearing a case filed by Sushil Kumar Gupta in 2024 against Pineview Technology Private Limited for allegedly picking up his vehicle. On September 1, the magistrate had ordered the SHO to register an FIR under IPC sections 379 (theft) and 34 (common intention) against the firm. When the case was heard next on September 3, the SHO had not registered a case against the firm and was issued a showcause notice.

Three days later, a sessions court stayed the order directing the filing of an FIR. On September 8, JMFC Kapoor noted that only the order on registration of FIR was stayed and not the show-cause notice issued to the SHO.

He noted that the failure of the SHO in not registering the FIR is “prima facie deliberate and willful”.

“The aforesaid conduct of SHO PS Vikas Puri amounts to an offence…as the SHO has knowingly disobeyed the directions issued by this court…with the intent to cause obstruction to the process of administration of justice and by his said act he has also caused annoyance to
the complainant and this court,” he added.
