Delhi Assembly issues notices to 3 top Punjab Police officers over FIR against Kapil Mishra, others

The Delhi Assembly on Saturday issued notices to three Punjab Police officers, asking them to reply within 48 hours after an FIR was lodged in Jalandhar against Law Minister Kapil Mishra for allegedly sharing a doctored video of the Assembly proceedings in the Capital.

The notices have been issued to Punjab’s director general of Police (DGP), Special DGP (Cyber Cell) of Punjab and the Jalandhar Police Commissioner, Speaker Vijender Gupta told media persons.

The Jalandhar Police Commissionerate had on Friday registered booked Mishra for allegedly uploading and circulating a doctored
video, in which Leader of Opposition Atishi is allegedly seen insulting Guru Tegh Bahadur in the Assembly on Tuesday after a debate on a programme held last November to mark the 350th martyrdom day of the ninth Sikh Guru. A day later, Mishra had shared the video from his X account.

According to the notices issued by the Delhi Assembly Secretariat, the video has been referred for forensic examination and to the Committee of Privileges.

The Assembly also asked for all the related documents and the forensic report, based on which Punjab Police claimed that the video was “doctored”, Gupta said.

“The matter is of extremely serious and constitutional importance and is directly linked to the dignity, authority, and privileges of the House. The issue is not confined to any individual or political party,” he added.

Gupta said that any recording of proceedings inside the House is the exclusive property of the Assembly and does not belong to any political party, individual, or external agency. “Misuse of the property of the House in this manner, and registration of an FIR against a minister on the basis of such material, is not only unfortunate but also extremely serious and condemnable,” he added.

He questioned on what basis and under what authority the FIR in this matter was registered by Punjab Police. “The role of the Jalandhar Police commissioner in the entire episode is highly questionable and appears prima facie to be a clear case of breach of privilege of the House. A direct case of privilege violation is therefore made out against him and the House will consider it seriously,” Gupta said.

Further, he pointed out that describing the official recording of the House as “tampered” or “doctored” amounts to a direct attack on the dignity of the Assembly. “This is not merely a false allegation but appears to be a well-planned conspiracy aimed at undermining the prestige of the House and maligning constitutional institutions… Anyone found directly or indirectly involved in this conspiracy will face the strictest possible action by the House,” Gupta said.

The BJP MLAs have demanded cancellation of Atishi’s Assembly membership for allegedly “insulting” the Sikh Guru. “She (Atishi) was asked to simply offer a brief apology, but she refused to do so; otherwise, the matter would have ended there itself, ” Gupta said.

The AAP, meanwhile, demanded Mishra’s Assembly membership to be revoked.. “The AAP is firm in demanding the immediate termination of BJP Minister Kapil Mishra’s membership over the ‘beadbi’ of Sikh Guru Sahibs,” it said.
