A Delhi court while acquitting a man of rape charges, has ordered perjury proceedings against the woman — for falsely implicating the man in the rape case.
Additional Sessions Judge Nivedita Anil Sharma has ordered court staff to make out the complaint against the woman before the Court of Metropolitan under the Section 195 CrPC — for committing perjury.
“The facts make it clear that the complainant despite knowing that accused is not the same man who committed the offence against her, still falsely implicated him in a criminal case of a very serious nature and pursued it by opposing his bail application… She has given false information to the police, a public authority,” the court observed.
The court directive comes in the case where the woman had filed a case against a Delhi resident at Paschim Vihar police station. In her complaint, she alleged that after seeing a job advertisement, she had gone to his godown in Jawala Heri market and he had raped her.
Acquitting the man of the charges of rape the court said, “As the complainant has committed perjury and other offences, as discussed above and also admitted by her, I deem this to be a fit case for making a court complaint against her to the court of CMM for prosecution for perjury and other charges.”
She had alleged that the man gave her water laced with sedatives due to which she became unconscious and he raped her. After raping her, he destroyed the bedsheet to destroy evidence, she had claimed. The woman in her deposition before the court failed to identify the man, stating that he was not the same person who raped her.
The court said, “The complainant has not deposed an iota of evidence of her being raped by the accused. She has not even identified the accused nor deposed anything incriminating against the accused.”
