Holding that a clinic being run from a residential property was not in violation of the municipal by-laws,the Delhi High Court on Monday quashed the proceedings against a 80-year-old doctor,who was being prosecuted for operating a private clinic from his house.

New Delhi: Holding that a clinic being run from a residential property was not in violation of the municipal by-laws,the Delhi High Court on Monday quashed the proceedings against a 80-year-old doctor,who was being prosecuted for operating a private clinic from his house. The court relied on a Supreme Court judgement and noted that running a clinic was a “professional” activity and not “commercial” in nature.Hence,the professional establishment of a doctor cannot come within the definition of “commercial” activity under the Delhi Municipal Act. Dr D V Chug was booked by the MCD in 2004 for running a clinic from his house in Rajouri Garden area.
