Murdered Noida schoolgirl Arushis mother Nupur Talwar faced arrest on Wednesday after a special CBI court issued a non-bailable warrant against her for failing to appear in court at the end of the one-month relief given to her by the Allahabad High Court.
Later in the day,a CBI team landed at the Talwar home in Hauz Khas in South Delhi,looking for Nupur but she was not at home. The CBI team left after 45 minutes.
In May 2008,Arushi was found with her throat slit at her Noida home and the body of Hemraj,the domestic help who was initially a suspect,was found on the terrace a day later. Arushis parents Rajesh and Nupur Talwar,both dentists,are now accused in the case and have been ordered to stand trial.
In the court of Special Magistrate Preeti Singh,Nupurs counsel argued that since a review petition against her arrest was pending before the Supreme Court,she should be allowed to stay away from the CBI court until an outcome.
The CBI counsel,on the other hand,pressed for a non-bailable warrant saying she was wilfully evading her appearance in this court. He argued that since the one-month leeway given by the court to decide her bail plea on March 13 had lapsed and since she had not appeared in court,a non-bailable warrant must be issued.
R K Saini,senior prosecutor for CBI,said,The earlier High Court order does not hold anymore. We submitted an application in the Allahabad High Court on April 5,asking the High Court to recall its decision of March 13,as she had filed for an extension by concealing facts. The High Court on April 13 suspended the order,in front of both sets of counsels. So presently,there is no protection to Nupur Talwar.
Special Judge Preeti Singh said a non-bailable warrant was being issued against Nupur as she had not adhered to the High Court order by not appearing in court on Wednesday. The court fixed April 18 as the next date of hearing.
