UT Police asks HC to dismiss MLA’s plea

The case has been listed for arguments on April 15.

UT Police,on Friday,sought the dismissal of the application moved by Doon MLA from Himachal Pradesh,Ram Kumar Chaudhary,in which he noted that the challan filed against him was inconclusive and some reports had not been provided to the accused. The case has been listed for arguments on April 15.

In a written reply filed before the court of chief judicial magistrate Bhawna Jain,it was pointed out that the list of documents had already been attached with the report filed by the police in the case.

The police application further noted that a copy of FSL report,chemical examination report and the opinion of the doctor has already been attached with the report under section 173 of Cr PC. Police also denied the defence plea that further specimen signatures and handwriting samples of the accused that were taken were enough and that the challan in the case was incomplete. It also denied that the copies of challan supplied to the accused were short thereby preventing the counsel of the accused to scrutinise the challan.

Police,however,admitted that it obtained the specimen hand-writing and signatures of the accused in the case on April 3 and the FSL report obtained from FSL Madhuban was inconclusive. However senior police officials said that the FSL report of Chaudhary,in the application,was only inconclusive to the extent that they need to check the over-writing on the records of Jindal nursing home allegedly made by the MLA when he took Jyoti Kumari there to abort her baby.

The MLA had written his name at the time of admission in the case which has been confirmed by the handwriting report of FSL,however the MLA also did over-writing and changed his name from Ram Kumar to Ramesh Kumar in the nursing home records.
