Chandigarh Consumer Disputes Redressal Forum-I has directed real estate company Emaar MGF to pay interest at the rate of 12 per cent over the Rs 35.21 lakh deposited by Lalit Arora of Sector 8,Panchkula,for not giving him the possession of the plot for which he had applied by the agreed date.
President of the Forum P D Goel and members Rajinder Singh Gill and Dr Madanjit Kaur Sahota have also directed the company to pay Rs 25,000 as compensation to Arora for adopting an unfair trade practice and causing harassment,and Rs 10,000 as cost of litigation.
In his complaint,Arora had stated that he was allotted a plot measuring 300 square yards by the company at its project titled
He complained that as per agreement dated June 2007,the project was to be completed within two years.
But when he visited the site,he found that no development work like roads,sewerage,electricity poles and other basic amenities had been provided by the company within the two-year period.
The Forum observed that the company was required to provide the basic infrastructure before handing over possession of the plot.
The Forum served a notice to the company regarding the case,but it did not make an appearance in the court.
After considering the case,the Forum directed the company to pay interest to Arora for the amount deposited by him,and also compensate him for the harassment caused to him.
