Owing to the prosecution’s inability to produce credible evidence lead to the acquittal of all the accused in the Kulwinder Singh,kid encounter case which dates back to 1989.
On May 10,the CBI Special Court had acquitted six Punjab Police personnel including Surjeet Singh Grewal,who is presently the Senior Superintendent of Police(SSP),Moga,in the 23-year old Kulwinder Singh alias Kid’s ‘fake encounter’ case. All the accused were acquitted as prosecution failed to prove their case.
It is evident that the prosecution has not produced clear,cogent,credible and convincing evidence to prove the guilt of the accused.It is held that prosecution has failed to prove the guilt of all the accused, read the order.
The order further mentioned that the there was not an iota of evidence regarding identification of body of unknown terrorist to be that of Kulwinder Singh.
The prosecution had claimed that on July 22,1989,Kulwinder Singh,was allegedly abducted from Phase 5 Mohali by SSP Grewal and six others and eliminated in a fake encounter.
