The Police Complaints Authority (PCA) has recommended disciplinary action against the Investigating officers (IO) who had been sitting over investigations of a criminal case.
The order was passed by PCA on Meenakshis complaint. She had filed a criminal case on April 17,2010 against her husband Dheeraj,and in-laws after having a troublesome relationship. In her complaint to Sector 34 Police Station,she alleged that Dheeraj accompanied by others,had beaten her brother several times.
An FIR was registered on April 22,a delay of five days. Meanwhile,a cross case was registered against the complainant and her family. The case had already gone to court on August 8.
The criminal case registered on the complaint of Meenakshi did not proceed on proper course. Assistant Sub Inspector (ASI) Narinder Singh did not promptly proceed to arrest the accused persons and acted in a malafide manner, read the order.
The PCA,through an earlier order on June 24,2011,had noticed that the first the IO Narinder Singh did not promptly make the arrests of the accused and therefore the next Investigation Officer Sub Inspector (SI) Pradeep Kumar also did not proceed to register the case of dowry offences as demanded by the the complainant.
Meenakshi approached the court in July 2010,which passed an order on July 27,2010 asking Police to register a case for dowry offences also. However,the offences were belatedly added by the IO after five months on December 12. Dowry articles were recovered by him on February 12,2011.
Meenakshis grievance was that police had not filed a challan in court in the case registered on her complaint. However,a challan was promptly filed in the court against the complainant and her family,but had deliberately and vindictively withheld the challan in the counter case.
The order further reads,The investigation has shifted from one police officer to another for no justifiable reason. The investigation appears to have also been carried out for some time by SI Randhir Singh and after him by SI Ramesh Chander. There appears no plausible and convincing reason to sit over the case and not sending it to court. This is how the complaint is being harassed and made to suffer for having earlier made a complaint before the PCA against the Investigating Officers. They appear to be now acting in a revengeful and vindictive manner. Challan against her and her parents has been sent to the courts long back while he counter complaint is lying at the police station for two years. It is a glaring abuse of power,malafide and arbitrary non action.
