Panchkula civic body to identify,punish those behind cattle menace

The Municipal Council of Panchkula will identify the people behind the cattle menace in the city. In a meeting which took place today between Deputy Commissioner (DC) Ashima Brar,SP Panchkula Maneesh Chaudhry and Executive Officer K K Jain,a re-survey for identification of such people was decided.
Meanwhile,administration is mulling issuing orders under Section 133 of CrPC to declare cattle menace a nuisance. The Sub Divisional Magistrate is empowered to issue order under Section 133 of CrPC to remove any unlawful obstruction or nuisance from public places or roads.
“About six months ago we had found about 30 such people who catch these stray cattle,milk them and then leave them. There are five to six people who use about 150-200 stray cows. We had issued notices to them. The present identification will help ascertain whether these are the same people against whom notices were issued,” said K K Jain.
Meanwhile,it was found that the MC had lost the file about the 12-acre land in Pinjore,where a cattle shed was proposed.
Now it has taken a photocopy of that file from a copy available in the DC office.
The Haryana government had sanctioned the land in Pinjore for a cattle shed so that the menace of Panchkula city,Pinjore and Kalka could be eradicated in the year 2009.
Rs 1.75 crore was also sanctioned at that time. But it was handed over to a third party by Pinjore Municipal Committee.
Since then,there has been no progress on the project.
Ravinder Rawal,President,Municipal Council,said,“We are the owners of the land,but have not got the possession. After getting the land,we will soon handover the contract of moving stray cattle from the roads to the cowshed.”
On the other hand,the drive through the city roads has become precarious.
Mukesh Kumar,resident of Sector 4,said,“It looks as if we have reached a rural area. The cows are moving in herds on city roads. Yesterday,I barely avoided an accident.”
Pritika Kapoor,resident of Sector 8,said,“Roads are for vehicles,not for cows. No authority is catching them.”
“Presently,we are not catching the stray cattle because there is no place to keep them,” Rawal said.
He added,“SP Panchkula has been asked to register case against those who catch cows,milk them and leave them.”
Maneesh Chaudhry,SP Panchkula,said,“SDM has to issue orders under Section 133 of CrPC to describe cattle menace as nuisance. Only after that we will be empowered under Section 188 of IPC to register a FIR against such people.”
In the MC budget this year,Rs 1 crore has also been proposed for shifting of milk dairies outside the MC limit. This money will be used for acquisition of land for dairies.
Recently,a notice has been issued to Deputy Commissioner Ashima Brar,Municipal Council and SP Panchkula for a reply on a petition by a Panchkula-based couple,Pankaj and Sangeeta Chandgothia,under Section 91 of CPC,relating to “Public Nuisance”,for removal of stray cattle menace in the district.
The application claims that stray cattle are often found sitting or moving in the middle of busy roads,leading to sudden stopping of vehicles,giving rise to the risk of accidents and resultantly injuries and loss of life.
It also suggests a compensation policy,wherein the administration should be liable to compensate any person who suffers on account of the stray cattle menace.
