IT WAS a dream for many to have their own house in the Tricity. Lalit Kumar, a resident of Kharar, also had the same dream. He and his wife deposited money with a real estate company which did not give them the promised house. Kumar moved the Chandigarh Consumer Disputes Redressal Forum but his woes did not end there as the company neither gave the compensation for mental harassment nor refunded his money.
Kumar invested money in BCL Homes Limited at Kishanpura village, Zirakpur, to buy a flat. He alleges that the company did not refund his money to the tune of around Rs 5 lakh despite the order of the forum.
Kumar claims that he deposited Rs 50,000 in August 2011 to book a flat. In March 2012, the company represented that their project has been cleared by the government agencies and all approvals have been obtained. The complainant was asked to deposit Rs 4.5 lakh in the same month.
He says that the District Consumer Forum allowed the complaint in 2014 directing BCL homes to refund booking amount of Rs 5 lakh with 12 per cent interest from the date of deposit till realisation and a lump-sum compensation of Rs 20,000 for mental agony, tension, harassment and cost of litigation.
Pankaj Chandgothia, counsel for the complainant, says that the company never issued any allotment letter and kept on sitting over the money deposited by the complainant, without taking any steps to bring their proposed project into existence. When even after two years, there was no development, the complainants asked for refund of Rs 5 lakh.
Chandgothia says that the company issued cheques towards refund along with interest, but the cheques also bounced.
