Man acquitted of rape charge; 1995 sex scandal used as defence

Case involved the daughter of a woman who was involved in the infamous Jamalpur sex scandal in Ludhiana in 1995.

A Mohali court on Tuesday acquitted a man of rape charges but held him guilty of causing hurt and sentenced him to six months of imprisonment. The case involved the daughter of a woman who was involved in the infamous Jamalpur sex scandal in Ludhiana in 1995.

Davinder Singh,a resident of Sector 44,was booked in November 2009 after a 25-year-old woman alleged that Davinder tried to rape her and threatened to kill her at her cousin’s Sector 71 residence. The court had framed the charge of rape,attempt to rape and causing hurt under sections 376,511 and 323 of the IPC.

The defence counsel alleged that the mother of the victim was booked for running a brothel in Ludhiana and had several cases registered against her. The defence produced newspaper reports from The Tribune,Jansatta and other newspapers from June 1995 which said that a racket had been busted in Jamalpur colony in Ludhiana with help from two local MLAs.

Davinder,in his defence,said that he was married to the victim’s cousin,and had humiliated the victim and pushed her out of the house on the day of the incident as she often visited their house in obscene clothes.

The defence added,the victim’s family had borrowed Rs 4 lakh from Davinder and since they did not want to return the money,they levelled allegations of rape against him.
