Jagtar Hawara’s 25-year-old sedition case committed to sessions court
In his orders, JMIC Jagjeet Singh stated that after the presentation of challan, production warrant was issued to Jail Superintendent, Tihar Jail, Delhi for production of Jagtar Singh Hawara.
Hawara was produced before the court on April 20 through video conferencing and taken into custody. (File) The court of Mohali Judicial Magistrate (Ist Class) Jagjeet Singh has committed a 25-year-old sedition case related to Jagtar Singh Hawara to the sessions court. The sessions court will start hearing the case from August 8 onward now.
In his orders, JMIC Jagjeet Singh stated that after the presentation of challan, production warrant was issued to Jail Superintendent, Tihar Jail, Delhi for production of Jagtar Singh Hawara. On February 23, proceedings in the present case were ordered to be conducted through video conferencing only. Thereafter, Hawara was produced before the court on April 20 through video conferencing and taken into custody.
“I have heard the state counsel and counsel for the accused and also have gone through the file with their assistance. From the report, under Section 173 of CrPC and documents annexed therewith offences under section 124-A of Indian Penal Code (IPC) along with other offences appears to have been made out against the accused. As the offence under section 124-A IPC can exclusively be tried in a sessions court, therefore, the present case is hereby committed to the court of the Sessions Judge,” the court ordered.
