The UT Consumer Forum has slapped a penalty of Rs 10,000 on a leading insurance company for not giving interest on the insurance amount of around Rs 5,300 after a delay of ten months. The firm,United India Insurance Company has also been directed to pay an interest of 9 per cent on the claim amount from the date of its passing.
Padma Bhargava,a resident of Mohali received the claim for her car in April this year though the claim was passed in June,2012. Her car which was parked outside her house was hit by another vehicle. Causing damages on its left side. After getting the car serviced,Bhargava,a cancer patient,claimed that she got the claim amount worth Rs 5263 (as assessed by the surveyor of the company) passed with great difficulty but still did not receive anything from the company. Even though six months had already passed,it was only after rigorous follow-ups and filing of an RTI,the company informed her that the claim was delayed because of the insufficient bank details provided.
The company has,however,maintained that the claim amount was already deposited in her account in April,against which Bhargava contended that she was not intimated about,and also that the payment came without any compensation or interest for the delay.
Ruling that the complainant suffered on account of unnecessary delay,negligence and inaction on the part of the opposite party,the forum levied the penalty to be paid within a month.
