Himachal HC threatens action against officials for inaction on PIL against pollution
Himachal Pradesh High Courts Green Bench has taken serious exception to the lukewarm attitude of the state government officials in assisting the court in a Public Interest Petition relating to growing environmental pollution in Baddi-Barotiwala-Nalargarh industrial areas.
Himachal Pradesh High Court’s Green Bench has taken serious exception to the lukewarm attitude of the state government officials in assisting the court in a Public Interest Petition (PIL) relating to growing environmental pollution in Baddi-Barotiwala-Nalargarh industrial areas.
The PIL is based on The Indian Express report of 2006-2007,which the Green Bench had taken up and passed specific directions to the state government to set-up Common Effluent Treatment (CET) plant,Sewerage Treatment Plant and Municipal Solid Waste Management plant in Baddi-Brotiwala-Nalagarh area.
The bench comprising Justice Deepak Gupta and Justice Sanjay Karol during its last hearing in March 2011 noted that despite time being granted to the government and its agencies to file status report on the progress for setting up the plants no affidavit has been filed.
“We are not all happy with the manner in which the orders of the court are being treated by the senior officials of the government. When we issue directions,that too relating to the setting up of such an important plant like CET,which affects the health of lakhs of people,we expect the officials of the state to act with alacrity”,the Bench said.
The order further said,“by way of indulgence,one more opportunity is granted to file the latest status report”. The court however made it clear that since the case would be listed next on April 29,the officials failing to assist the court properly will be acted against.
The court had appointed advocate Jyotsna Rewal Dua as amicus curiae in the PIL.
