High Court scraps re-auction of 0006 registration number

The petitioner had contended that his bid of Rs 16,500 was accepted and he was declared successful in the auction for number 0006

The Punjab and Haryana High Court on Monday scrapped the re-auction of registration number (CH-01-AU 0006) by the Chandigarh Administration. Also,the high court has come down heavily on the Registering and Licensing Authority (RLA) for its ‘arbitrary and unreasonable’ decision.

Directions were passed on Monday on a petition filed by Advocate Nitin Goyal who sought quashing of the notice for re-auctioning registration number CH-01-AU 0006.

The petitioner had contended that his bid of Rs 16,500 was accepted and he was declared successful in the auction for number 0006. But,the next day,on August 3,he came to know from the newspapers that the RLA has recommended cancellation of auction of seven numbers on the ground that the auction fetched price lower than expected.

The petitioner made a representation to the RLA saying only two other applicants bid for the number. There was no question of hobnobbing between the petitioner and the other applicant.

He added,“Till date,neither the order of cancellation of auction has been communicated,nor the representation of the petitioner dated August 3 has been decided by the respondents.” The petitioner had argued the action of the respondents in canceling the auction is illegal,unconstitutional,arbitrary,discriminatory and liable to be set aside.

His bid,the highest for ‘0006’,was accepted by the auctioning authority. It could not have been cancelled and re-auctioned. His petition was opposed by the RLA.

It was claimed by the RLA that there was nothing amiss in the re-auction. Finding force in the contentions raised by the petitioner,the high court on Monday scrapped the re-auction of the registration number. Also,the high court directed RLA to allot the number to Goyal at an early date.
