For being deficient in service,the UT District Consumer Disputes Redressal Forum imposed a fine of Rs 2 lakh on a Zirakpur real estate company along with an amount of Rs 10,000 as litigation costs.
Bharat Bhushan Bawa had purchased a flat in Phase III tower of the upcoming project at the Kalka-Ambala Road of the New Generation Real Estate Ltd,attracted by its advertisements.
However,after moving in 2005,he found that as advertised and projected by the companys authorities,the house and the housing complex lacked in a lot of facilities. The complexs entrance was now completely defaced and looked nothing like he was shown earlier. A park in the complex that was shown in the companys brochure was missing,he said.
It was also brought to forums notice that the upcoming project was not approved by the Government of Punjab as was promoted by the company. On finding that the company mislead Bawa and other consumers,the forum maintained that the firm indulged in unfair trade practices.
The company was also found to be wrongfully projecting itself to be registered with the Punjab Government at the time when it came out with the advertisements,as it is still awaiting the concerned authoritys approval.
Finding force in Bawas contention New Generation Real Estate has been ordered to pay the compensation within a month failing which he would be liable to pay double of the amount with a 9 per cent interest. The firm has also been directed to supply the complainants with a occupation and completion certificate which was still not made available despite several requests.
