Deciding on a petition filed by a builder,a lower court has permitted R S Infrastructures Limited to continue to operate and collect the toll at the Dera Bassi toll plaza till March 27,2009. The agreed period of contract as per the Build,Operate and Transfer agreement dated September 8,1999,expired on March 14,2009. The petitioner had sought an extension for collecting toll on the grounds that the Arbitration Tribunal has not granted him any other compensation besides an extension of seven months.
The court admitted that the additional claim of the applicant for the loss caused due to closure of Ghaggar Bridge from August 14,2006,to August 31,2008,is also pending with the State of Punjab and Ministry of Road Transport and Highways.
The Court of Additional District judge Ravi Kumar Sondhi ruled: The contractor is permitted to continue with the operation of the toll plaza as per the earlier rates and the respondents will not cause any hindrance in the same. However,this order is subject to the condition that the applicant will keep an account of the collections till the next date of hearing in a separate account.
