A woman has approached a court,claiming a 50 per cent share in the properties owned by her estranged husband. A resident of Delhi married to a local resident (names withheld),has filed a civil suit before a lower court.
The wife has claimed 50% share in the properties of her husband and in the family properties,and sought direction from the court to restrain them from selling or transferring their properties to defeat her legal rights,besides seeking full disclosure of their properties.
In the suit,the estranged wife has averred that her husband,claiming to be a millionaire and an influential person of the city,contracted a second marriage with her by luring her on Shaadi.com into on false promises.
The woman has further claimed that just after 15 month of marriage,her husband,in conspiracy with his family members shunted her out from the matrimonial home in a cruel manner on March 11,2012 and did not allow her to enter the house by locking the gates of the house at Delhi.
The woman claims that she was left on the road in the middle of the night to fend for herself. She filed her complaint with Delhi Police,who after detailed investigation,has registered an FIR on January 23 against the husband and his family members on charges of cruelty and furtherance of common intention under Sections 406,498-A and 34 IPC.
The woman also alleged that even during the short period of marriage of 15 months,she was subjected to grave mental and physical cruelty by her husband and his family members whenever she objected to his consumption of alcohol and other habits.
The womans lawyer,Advocate V K Sachdeva,has also alleged that the husband has misappropriated her entire hard-earned life savings of Rs 16 lakh and all her belongings including clothes,jewellary,house hold goods and other important documents,like her passport,educational certificates etc.were not given to her and are still in their possession.
This case assumes significance since its the first of its kind,where the estranged wife has approached the court to seek her due share in the properties of her husband and family when a law on this issue is under active consideration of Parliament,to legally entitle estranged wives to 50% share in the properties of their husband and his family.
The court has issued a summons against the husband and his other family members to appear before it on June 11.
