Coming as a major set back to Doon MLA from Himachal Pardesh,Ram Kumar Chaudhary,a lower court on Thursday turned down the MLAs plea to provide him the details of the tower location of his and deceased Jyoti Kumaris phones.
The MLA had pleaded before the court of Chief Judicial Magistrate Bhawna Jain that he should be provided details of tower locations,after the police charged him for allegedly murdering Jyoti. The police had stated that investigations revealed that the MLAs phone was traced to the same location where she was found murdered on November 22,2012.
The court asked the police that it should state in an affidavit that it had only one CD of the call details between the MLAs wife,Nidhi,and the deceaseds uncle. The MLAs wife has been alleged of trying to pay money to the deceaseds family to withdraw the case. The police had,earlier,contended before the court that it cant provide the CD to the MLA,as it had only one CD that it had submitted before the court. In the documents given to Chaudhary,the police had provided the details of the call transcripts of the MLAs wife and Jyotis uncle.
The CJM,in an order,turned down the plea of the MLAs counsel that since the documents that were submitted in court by the police didnt include the details of the tower location,it should be provided separately to him.
The police had contended before the court that the tower location details werent supplied to the accused,as they were part of the investigation and not made part of the challan.
Earlier in the charge-sheet,the police had attached the call details of the cell-phone numbers of the accused and deceased. Counsel for the accused,Amandeep Bindra,said that the police hadnt submitted the complete documents with the challan.
Bindra said that they were seeking the CD of the call details of Nidhi to ascertain whether it had been doctored. Although we were provided with the transcripts of the call details of Chaudharys wife,we want the CD that has the call details.
The police had,earlier,submitted the post-mortem report of the deceased girl and the FSL report of the MLAs handwriting before the court. The post-mortem report had pointed out that the girl suffered multiple injuries,while the FSL report has confirmed that the MLA wrote on the documents at the Chandigarh-based nursing home to admit the girl for abortion.
