The Motor Accident Claims Tribunal (MACT) has awarded a compensation of Rs 49.54 lakh to a cyclist who had lost his leg after being hit by a truck in Panchkula.
The tribunal ruled in favour of Heera Singh, 37, a professional chef, holding the truck driver, owner and insurer liable for the accident that left him permanently disabled.
According to the case, Heera Singh, who was working as a chef at a private hotel in Panchkula, met with the accident on April 14, 2023. The petition mentioned that the incident occurred around 1.30 pm when he was returning home on his bicycle after finishing work. As he reached the traffic light point between Sectors 4 and 12 in Panchkula, a truck rammed into his bicycle. The impact threw Heera Singh on the road, and the truck reportedly dragged him for some distance, causing severe injuries. He was immediately rushed to the Post Graduate Institute of Medical Education and Research (PGIMER), where doctors found multiple fractures in his legs. Due to the seriousness of the injuries, one of his legs had to be amputated, resulting in permanent disability.
Following the accident, the victim approached the MACT through his counsel, Advocate Sunil K. Dixit, seeking compensation for the losses he suffered due to the accident. In his petition, Heera Singh stated that he was earning around Rs 25,000 per month as a chef at a private hotel and that his profession required him to stand for long hours while performing tasks such as washing, cutting and preparing food.
Dixit argued before the tribunal that working as a chef without a leg had become extremely difficult for the petitioner, directly affecting his earning capacity and future livelihood. He submitted that the accident had not only caused physical trauma but had also resulted in financial losses and long-term hardship for the claimant.
The respondents in the case included the truck driver, identified as Chhote Lal, a resident of Sector 25, Panchkula, the truck owner, RN Contractors, and the insurance provider, United India Insurance Company. The respondents opposed the claim, contesting their liability for the accident.
After hearing arguments from both sides and examining the evidence on record, the tribunal held the respondents responsible for the accident and awarded compensation of Rs 49.54 lakh to Heera Singh, taking into account medical expenses, loss of income, future earning capacity and the permanent disability suffered by the claimant.
