Court orders company to refund amount for booking of car

The UT District Consumer Disputes Redressal Forum,ordered the New Holland Fiat (India) Private Limited,Mumbai and Amardeep Motors Limited Industrial Area,Chandigarh to refund the amount spent by Jagdish Marwaha,a city based advocate,the amount of booking an ‘Uno car’.

The UT District Consumer Disputes Redressal Forum,ordered the New Holland Fiat (India) Private Limited,Mumbai and Amardeep Motors Limited Industrial Area,Chandigarh to refund the amount spent by Jagdish Marwaha,a city based advocate,the amount of booking an ‘Uno car’.

According to the order by the court,the New Holland Fiat (India) Private Limited and Amardeep Motors Ltd are together liable to pay the booking amount of Rs 21,000 with an interest rate of 12 per cent per annum,compounded annually from February 15,1996.

In addition,as compensation for mental agony and harrassment suffered by the complainant,Jagdish Marwaha,the parties have to pay Rs 25,000 as compensation and Rs 7,000 as costs of litigation within 45 days.

If the two parties fail to abide by the said order within the date,the interest shall be compounded at the rate of 18 per cent per annum till actual payment.

The complainant in the case,Jagdish Marwaha,had booked an Uno Car in the year 1996 after seeing it displayed in Sector 22. The counter was also open for booking where Marwaha booked a car for himself on February 15,1996 for Rs 21,000.

According to Marwaha,the last communication that he received was a consent continuation of the booking of the Fiat Uno car on October 17,1997.

However,after that the complainant did not receive any other intimation to claim the car. Finally,on January 3,2005,the complainant served a legal notice to refund the booking money with interest.

However,the opposite parties in their written statement denied that they illegally and unlawfully retained the booking amount of the Uno car.

They also claimed that the complainant neither came forward to take delivery of the vehicle nor asked for refund of the booking amount,within the limitation period.
