The Punjab and Haryana High Court has issued notices to the Senior Superintendent of Police (SSP),Chandigarh; Block Development and Panchayat Officer,Chandigarh; and Gram Panchayat,village Daria. The notices have been issued in response to a public interest litigation filed by one Jaswant Singh,a resident of the same village.
The petitioner has challenged the validity of the imposition and collection of Entry Tax in the name of Gram Parvesh Tax in the village. The petitioner argued that the imposition of the tax is in utter violation of the Constitution,since no approval of a competent authority was obtained by the gram panchayat before enforcing the same.
It was contended that by virtue of the said illegal tax,the village sarpanch and contractor have been pocketing lakhs of rupees from vehicle owners since April. Alleging high-handedness,the petitioner has demanded a thorough probe in the scandal since the illegal tax collection is reportedly going on despite the Director,Rural Development and Panchayats,Chandigarh,advising against the collection.
