Besides recommending an FIR against former Chief Parliamentary Secretary (CPS) Ashok Bhayana, Haryana ADGP V Kamaraja, in his inquiry report, has recommended registration of criminal cases under the Prevention of Corruption Ac against four other former Haryana Congress MLAs allegedly involved in the cash-for-change of land use (CLU) case.
These are former health minister Rao Narinder Singh, and former MLAs Jarnail Singh, Naresh Selval and Ram Niwas Ghorela. The compact discs were released by INLD leaders in September 2013.
Though the report pertaining to Bhayana’s case went public today, sources said the report in other four cases was also same, and that in all the cases the Haryana Police’s inquiry has found the CDs to be “authentic”.
Kamaraja, in his five separate reports against the five Congress leaders, has submitted to the Lokayukta that prima facie case is made out and criminal case under the PCA may be registered and investigated against the MLAs.
The Haryana Lokayukta Wednesday reserved his judgment in the case after hearing arguments of all parties.
Appearing for the INLD leaders, advocate Naresh Shekhawat said whatever be the outcome of the case, the Lokayukta in his judgment would give his recommendations to the state. Any of the aggrieved party can move the High Court to challenge the Lokayukta judgment.
Earlier, the Punjab and Haryana High Court had on February 27 quashed the Haryana Lokayukta’s order for registration of a criminal case against former Haryana Chief Parliamentary Secretary Ram Kishan Fauji after it found the CD — showing Fauji allegedly seeking Rs 5 crore for getting CLU permission for a Gurgaon land in September 2013 — unauthentic.
After the high court verdict, other five Congress leaders had moved applications before the Haryana Lokayukta in April seeking dismissal of complaints against them on the ground that Fauji was also facing similar case and it was dismissed by the high court. They had also submitted that the complaints against them does not sustain since the Lokayukta’s office could not decide the case within one year as per the Lokayukta Act.
INLD leaders had alleged that former minister Rao Narender Singh was caught on camera while demanding Rs 30-50 crore for getting the CLU done of a 30 acres land, while Vinod Bhayana, Hansi MLA, was allegedly demanding Rs 2.5 crores for a 4.5 acres plot in Gurgaon, Jarnail Singh, Ratia MLA, was demanding Rs 3 crore for getting a colony license for a Group Housing Society in Sector 31 of Faridabad, Ram Niwas Ghorela, Barwala MLA was allegedly demanding Rs. 50 lakh for getting a school constructed on the site of a brick kiln, Naresh Selwal, Uklana MLA was allegedly demanding a bribe of Rs. 10-12 crores for withdrawal of Section 6 notification from a 3000 square yard land in Gurgaon’s Sector 45.
