In three separate cases, the State Consumer Disputes Redressal Commission has directed a real estate company to pay Rs 3 lakh each to three complainants.
The commission has also asked Emaar MGF to refund Rs 48,18,000 to Shipali Sharma, a resident of Panchkula, apart from paying a compensation of Rs 3 lakh.
In the second case, the commission asked the company to pay a compensation of Rs 3 lakh other than refunding Rs 35,21,604 to Pawan Kumar, a resident of Sector 40.
In the third case, the company was asked to pay Rs 3 lakh to Jit Singh, a resident of Kapurthala, and refund the amount he had deposited.
The three complainants had invested money in the project, Mohali Hills, located in Mohali. The complainants were assured that they will be given the possession of the unit within 12 months from the date of booking of the plot.
However, the company failed to complete said the project in time. The possession was offered to the complainants and an additional amount was also demanded. When the complainants visited the site, they were shocked to see that there was no development at the site.
The complainants then filed a case in the consumer courts against the builder. The real estate company has taken objection regarding arbitration clause in the agreement.

It also moved an application u/s 8 of Arbitration and Conciliation Act, 1996, taking a specific objection in this regard for referring the matter to the Arbitrator in terms of the agreed terms and conditions of the agreement. It was further stated that the complainant has not revoked the contract due to alleged delay in handing over possession.
