BMW murder case: Frame murder charges against Farid, court orders

Meanwhile, the orders on Harmehtab’s bail will be pronounced by the court on November 3.

The court on Saturday ordered to frame charges against Harmehtab Singh alias Farid under sections of murder, which will be framed on November 7, the next date scheduled for the case. The court of additional and sessions judge ordered to frame charges against Harmehtab under Section 302 (punishment for murder) read with Section 34 (acts done by several persons in furtherance of common intention) of the IPC. Meanwhile, the orders on Harmehtab’s bail will be pronounced by the court on November 3.

Earlier on October 24, during an argument, Harmehtab’s defense counsel denied the charges and stated that ‘none of the reports confirmed anything against him and it was not a case of intentional murder’ whereas the defense, Advocate AS Sukhija argued that Section 302 (murder) must be dropped and instead it should be replaced with Section 304 (culpable homicide not amounting to murder). The prosecution had stated that after Balraj, the driver of the BMW car, hit Akansh Sen, Harmehtab asked the driver to run over him over again as he was not yet dead and provoked Balraj.

However, the defense had argued that it is a case of accident as there was no motive of intentional murder and since the youths were in an inebriated condition at the time, there was no possibility that anyone could have heard as how Harmehtab instigated Balraj.

However, the prosecution took up the statement of Sen’s friend Shera and established that there was old enmity between Shera and Harmehtab which led to the incident.
