The National Investigation Agency (NIA) on Tuesday produced four accused in the Samjhauta blast case before the court of additional district and sessions judge,Sanjay Sandhir. The NIA produced Kamal Chauhan,Swami Aseemanand,Lokesh Sharma and Rajinder Chaudhary before the court on Tuesday.
In the blast case,the arguments were made on the bail application moved by Swami Aseemanand which was listed for orders on April 22. Counsel for Swami Aseemanand,Nardev Sharma,on Tuesday pleaded before the court that the accused should be granted bail as the NIA has built a false case against him. He pointed out that Swami Aseemanand is being tried under the Unlawful Activities Prevention Act (UAPA) even though there was no provision within the Act for charging people in the collusion of terror cases. Sharma had earlier noted in the bail application that UAPA was amended only in the year 2008 and the UAPA should not be made as the basis of the charges against the 2007 bomb blast accused. The other contention by Swami Aseemanand before the court are that the US government in a report had earlier stated that the terror attack was the handiwork of the LET militant outfit.
Nardev Sharma also argued in the court that the trialin the case should be held on a day-to-day basis,pointing out that the NIA was delaying the case by stating before the court that the investigations have not been completed.
However NIA counsel,R K Handa,said that the day-to-day trial in the case could not start as the investigation is still going on. He said that the NIA also asked the court that it should be allowed to file the chargesheet against the other accused Rajinder Chaudhary in the case within 180 days as the investigations in the case are still going on. The investigations in the case are on and are spread over many states, he said.
The appearance of the accused in the case was put after they were taken to Hyderabad and Rajasthan in other Mecca Masjid and the Ajmer Dargah blast cases. Swami Aseemanand and Lokesh Sharma were brought before the court from Rajasthan and Rajinder Chaudhary was produced from Hyderabad.
