29 years after encounter, Punjab police says it was fake

Twenty-nine years after Punjab Police claimed to have killed “militant” Gurnam Singh Bandala alias Neela Tara in an encounter, a Special Investigation Team (SIT) has informed the Punjab and Haryana High Court (HC) that the encounter was stage-managed and the FIR in the case was “registered by falsifying facts”.

Special DGP Gurpreet Kaur Deo, who also headed the SIT, made the submission through an affidavit in the case registered on July 29, 1994 pertaining to a police encounter in which one Sukhpal Singh was allegedly killed in Ropar. The police, however, had claimed that Bandala had been killed but subsequently it came to light that the militant was alive.

The affidavit mentioned that during investigation, certain facts and evidence have come across the SIT that proves that said case was registered on false grounds by the officers involved in the encounter.
Hence, the cancellation report of the FIR was submitted in the Court of Ilaqa Magistrate, Ropar on December 2, 2023, the SIT informed the Bench.

The affidavit also added that investigation revealed that the said police encounter in the case is stage-managed and the FIR is registered by falsifying facts.

Meanwhile, the SIT after taking legal opinion form District Attorney (Legal), Ropar, registered a fresh FIR on October 21, 2023, under Sections 166A, 167, 193, 195, 196, 200, 201, 203, 211, 218, 221, 222, 420, 120-B of IPC, at police station Singh Bhagwantpura in Ropar against Parmaraj Singh Umarnangal, the then SP (D) of Ropar, Jaspal Singh then DSP Morinda, and ASI Gurdev Singh then Incharge Police Post Lutheri (now deceased), for fabrication of evidence under IPC, which is currently under investigation by SP/Headquarters, District Rupnagar, stated the affidavit by SIT Chairman, Deol.

During the previous hearing, the Punjab Police SIT had submitted that it has arrested Avtar Singh alias Tari, and Sections 302 (murder), 201 (causing disappearance of evidence of offence, or giving false information to screen offender) of IPC in the FIR registered with police station Fatehgarh Churian in Batala.
The SIT had previously submitted before the HC that one Avtar Singh Tari played a critical role in the alleged abduction of Sukhpal Singh.

As per the case, in 1994, the Punjab Police team had claimed to have killed a wanted militant, Gurnam Singh Bandala, in an encounter, but he was caught alive in 1998, after which the family of one Sukhpal Singh of Kala Afghana village in Gurdaspur claimed that he was the one killed by the Punjab Police official. It was human rights activist Col G S Sandhu (retd) who first connected the dots after that and claimed that the person killed on July 29, 1994, was Sukhpal. Col Sandhu (retd) and Sukhpal’s family pursued the case and ensured that a probe was ordered under then Additional Director General Police J P Virdi in 2007. After a lull in probe due to Virdi’s death in 2010, Sukhpal’s widow Dalbir Kaur and father Jagir Singh approached the High Court for an inquiry by Central Bureau of Investigation in 2013.
