Karnataka High Court allows restoration of liver doctor Abby Philips’s X account subject to hiding contentious posts

The Karnataka High Court Monday allowed an application by Kerala-based liver doctor Dr Cyriac Abby Philips to restore his X account, subject to his hiding certain tweets (posts) that were a matter of contention until the matter is heard.
A Bengaluru civil court had issued a temporary injunction against communicating messages on his social media handle on products of the Himalaya Wellness Company. The ex parte temporary injunction had restrained him from posting or publishing defamatory remarks against Himalaya Wellness Company and ordered the social media service X Corp to block his handle.
The civil court passed the order on September 23 after the Himalaya Wellness Company approached the court stating that posts and messages by Dr Philips on alternative medicine products by the company were damaging its sales and benefitting competitors, namely Cipla and Alchem.
Dr Philips’s counsel argued that the trial court’s order was disproportionate in nature and that the entire account should not have been suspended ex parte. Justice S G Pandit of the high court agreed that if the nine posts that were the bone of contention could be hidden, the trial court’s order could be modified.
At the same time, the counsel noted that they were not admitting that the posts in question were defamatory. The matter is set to be heard further in November.
