BJP leader Subramanian Swamy on Thursday described an MHA affidavit in the Supreme Court supporting his prosecution for alleged hate speech as the handiwork of an “insane person in the law department”.
In an affidavit on October 28, the Ministry of Home Affairs (MHA) had told the apex court that Swamy violated IPC provisions with his writing. It added that Swamy, in his book Terrorism in India, made a “hate speech against a community of India”. However, the government on Wednesday sought to withdraw its stand in the apex court.
“There is an insane person in the law department, I will fish him out… I have found out where the inspiration for filing this affidavit has come from. I have found out who approved the draft. You will get to know in a few days,” Swamy said during a press conference here.
“I want to congratulate (Prime Minister) Narendra Modi…,” he said, adding, even the previous UPA government did not think something similar about the book. “…I don’t know who played the prank. But the signature in affidavit belongs to an undersecretary who is a junior officer in the Home Ministry,” he said.
The consent and signatures of Home Minister Rajnath Singh and the home secretary were not taken before the petition was filed, the BJP leader stressed.
“It is now being probed how it got filed. But, the government yesterday filed a fresh affidavit stating that they do not conform with the affidavit filed earlier and they are deleting a portion of the paragraph which deals with this issue,” Swamy said.
On the contents of his book, he said, “I had said just one thing that in the country if the Muslims accept that their ancestors were the Hindus, then we all will become part of one family. This is the fact as well. DNA studies have been conducted which prove that the DNAs of Hindus and Muslims are one. Where is the hate factor in this. I am talking about love and they are saying it is hate after almost 10 years.”
