A special CBI court Wednesday issued a notice to CBI,which is probing the 2003 encounter of Sadiq Jamal Mehtar,after allowing a petition by his brother – Shabbir Jamal Mehtar – seeking further investigation in the case,including that of the role played by Chief Minister Narendra Modi and the then minister of state for home Amit Shah.
While eight accused named in the chargesheet are squarely guilty of killing Sadiq in a fake encounter,there are several other accused who have participated in the conspiracy to profile him as terrorist. They have also involved in the conspiracy to create a story that Sadiq had come to Ahmedabad to kill Modi, Shabbir has stated in the application through lawyer Shamshad Pathan.
Shabbir has submitted the petition before the CBI judge V K Vyas to direct the probing agency to carry out further investigation under section 173 (8) of Code of Criminal Procedure (CrPC) to look into the aspect of profiling Sadiq as terrorist. Also the role and conduct of the officers of Subsidiary Intelligence Unit (SIB),Mumbai,and the then joint director of Central Intelligence Bureau Rajendra Kumar (currently posted in Delhi as special director) and officers of Detection of Crime Branch,Ahmedabad,in hatching conspiracy,illegally detaining,confining the victim in their offices at Shahibaug in Ahmedabad.
CBI in December,2012 had filed the chargesheet in this case under section 173 (8) of CrPC to probe the case further. The chargesheet has been silent on various aspects of the case including Mumbai-based former journalist Ketan Tirodar,who is out on bail in this case. It is to be noted that it was Tirodkar whose affidavit had spilled the beans in the case.
The applicant has also stated that following the order of the Gujarat High Court,Shabbir lodged a written complaint with DCB,Ahmedabad,in 2011 before handing over the case to CBI. However,instead of registering applicants complaint as FIR Mayur Chavda,ACP,DCB,had lodged an FIR of his own on May 20,2011.
So far in this case,eight accused policemen have been arrested including DSP Tarun Barot and J G Pamar (retired) who are also accused in Ishrat Jahan encounter case of 2004.
RBI chief to visit city today
The Governor of Reserve Bank of India (RBI),D Subbarao,is scheduled to visit the city on Thursday to address the RL Sanghvi-Ahmedabad Management Association Annual Economic Lecture. The RBI chief is expected to deliver a lecture on Indias Macro Economic Challenges: Reserve Banks Perspectives on the occasion.
