One of the accused-turned-witness policemen in the 2004 Ishrat Jahan fake encounter case, police inspector Bharat Patel is said to have told the CBI that the then Joint director of the Subsidiary Intelligence Bureau,Rajinder Kumar had told Gujarat police officers that “Amjadali Rana was a Pakistani terrorist and was in touch with Javed Sheikh alias Pranesh Pillai.” His statement is part of the charge sheet filed by the CBI. Patel also told the CBI that sustained interrogation of Rana in illegal custody of Gujarat police, made him confess that his mission was not to kill chief minister Narendra Modi.Patel, whose statement has been recorded under CrPC 169 as a witness before investigation officer DSP G Kalaimani of CBI,has said,“We were told by the joint director, subsidiary intelligence bureau (SIB) that Javed alias Pranesh Pillai, who was under watch by the IB for his associations and activities with Amjad Ali,was coming to Ahmedabad along with a girl (Ishrat). The JD (Rajinder Kumar) said that these persons would come in an Indica car,and gave us number and colour (blue) and directed to pick up both persons before they reached Ahmedabad.” The Indian Express has a copy of this statement. Javed’s father has said that his son was close to a “top Gujarat cop”.

Patel has also stated that Amjad had sneaked into India through Pakistan-occupied Kashmir along with 12 men. There was an ambush by security forces in Kashmir in which Amjad sustained injuries and was treated in Kashmir and Delhi. According to Patel,Amjad used to communicate with Pakistan through satphone (satellite phone) in matrix format.

“This development was conveyed to Vanzara (suspended IPS officer DG Vanzara) and Rajinder Kumar (JD,SIB) by Singhal (GL Singhal, accused IPS officer)… I had occasionally witnessed that Amjadali was also made to talk on the satphone with Muzzamil and on a cell phone for furthering the controlled operation.

These conversations used to be also recorded by the IB officers as per their system of record keeping,” Patel states in his testimony.

According to Patel,Amjad was abducted by accused DSP NK Amin and Tarun Barot on May 26,2004 and was kept at a unit of Gota housing society off SG Highway. Amjad had one satellite phone and lots of Indian currency in his possession. He was initially interrogated by Vanzara and Amin but he did not give in despite being beaten up badly.

Patel has claimed that it was Singhal who made Amjad speak up,before which nobody even knew his name. Patel has praised Singhal and claimed he was present during the interrogation of Amjad. He has said Amjad spoke up after hours of “patient and tactful” interrogation by Singhal and revealed his name and address as “Amjadali Akbarali Rana,a native of Sargoda in Pakistan and his motive was to carry out some terrorist strike.”

“This suspect had also told about Muzammil, the commander of LeT (Lashkar-e-Toiba)… He told me that their intention was to attack on some public place in Ahmedabad,Gujarat where a large number of people will gather (like Rathyatra),” Patel, who claims to have been present in some interrogation sessions, has stated in his testimony. Patel was among the five cops who got default bail after CBI didn’t file the chargesheet in time.

“…the motive of Amjad (Ali Rana) was not to assassinate the chief minister,as per my and Singhal’s (GL Singhal, accused IPS) interrogation,” Patel has stated.
