HC rejects PIL against extension to GAS officer

The Gujarat High Court (HC) on Thursday dismissed a Public Interest Litigation (PIL) challenging extension granted by the state government to a Gujarat Administrative Service (GAS) officer,Harsh Brahmbhatt,who retired as additional secretary from the General Administration Department (GAD) last year. A division bench of HC comprising Chief Justice Bhaskar Bhattacharya and Justice J B Pardiwala dismissed the PIL stating it was devoid of any merit. According to the PIL,moved by journalist and RTI activist Chandravadan Dhruv,Brahmbhatt retired on July 31,2012. On August 4,2012,the state government re-appointed him as additional secretary at the Chief Minister’s Office (CMO) in Gandhinagar. Dhruv contended that while Brahmbhatt’s importance was cited in the GAD department,he was appointed at the CMO. Also,he alleged,Brahmbhatt was granted a significant pay hike in the re-appointment at the cost of the public exchequer.
