HC judge tells Registrar: Am I disobeyed as I am not from state?

Justice Prasad’s comments suggesting that he is being discriminated against because of parochial considerations by the HC Registry came during the hearing of a contempt notice issued by a Division Bench comprising justices Bhagwati Prasad and J C Upadhyay against HC Registrar General (RG) P P Bhatt.

The contempt notice was issued against the RG,on Monday,for regularly putting up faulty paper books of various cases,which are not in accordance with the rules of the High Court. The Court had felt that this happened despite its repeated instructions to the Registry.

Bhatt appeared in person before the Division Bench on Tuesday. The state Advocate General represented him before the court.

The AG had tried to explain the reasons for the faulty paper books being placed before the court.

But Justice Bhagwati Prasad observed that this has been happening over the past one month despite repeated reminders.

It was at this point that the judge asked the AG if the Registry was taking him for granted by not taking the court’s instructions seriously since he was from Rajasthan and may go away in a few years.

“Whatever work I do is in the interest of the people of Gujarat. And I am not going to take this institution to Rajasthan,” said Justice Prasad.

He added: “I have a complete sense of resignation. If you want me to work,I’ll work. If you do not want me to work,I will not. I will work if the Registry wants me to work,and I will not work if the Registry doesn’t want me to work. I will be happy to have my peace of mind in my chamber.”

The AG,appearing on behalf of the RG,urged the Court not to carry an impression of discrimination against him by the Registry,assuring that the issue of mistakes in the paper books would be sorted out shortly. The AG also told the court that departmental steps will be taken against officials concerned in this regard.

Following the AG’s assurance,the Court discharged the contempt notice.

A senior counsel said that owing to the faulty paper books,the work of the Court was being seriously affected for around a month now.

“Think of a litigant who is paying the lawyer on each court appearance date. What will he do if the matter gets adjourned owing to faulty paper books and the registry keeping on repeating the mistake?” he asked.
