The Gujarat High Court Monday issued a notice to the CBI on the bail application filed by suspended deputy superintendent of police N K Amin,arrested in 2004 Ishrat Jahan fake encounter case. The court scheduled the matter for further hearing on August 6.
Amin,whose default bail had been rejected by a CBI court earlier this month,moved the High Court.
He has sought his bail stating that CBI chargesheet is incomplete,hence he should be granted bail under 167 (2) of code of criminal procedure (CrPC). Under this procedure default bail is given if the chargesheet is not filed within the stipulated period of 90 days following the arrest.
Amin,who is also an accused in the 2005 Sohrabuddin Shaikh fake encounter case,was among the seven policemen chargesheeted in Ishrat Jahan encounter on July 3.
In this encounter 19-year-old Ishrat,Javed Sheikh alias Pranesh Pillai,Zeeshan Johar and Amjad Ali Rana were killed on the outskirts of Ahmedabad in the joint operation allegedly by Gujarat police and IB officials.
