Court reserves order on Zakia plea till April 10

The Ahmedabad Metropolitan Court today reserved its order on the fresh plea of Zakia Jafri demanding the report on the 2002 riots submitted by the Special Investigation Team (SIT) before the court.

The Ahmedabad Metropolitan Court today reserved its order on the fresh plea of Zakia Jafri demanding the report on the 2002 riots submitted by the Special Investigation Team (SIT) before the court. After hearing the arguments,the court reserved the order for April 10.

Zakia,widow of former Congress MP Ahsan Jafri,had filed a fresh application on March 16,requesting a copy of the report filed by the Supreme Court-appointed SIT.

The SIT report is based on Zakia’s allegations in which she has accused Gujarat Chief Minister Narendra Modi and 61 other high-profile people including bureaucrats,politicians and police officers,of alleged complicity in the 2002 communal riots.

Delhi-based counsel for the SIT,R S Jamuar opposed Jafri’s fresh petition stating that although she is entitled to get a copy of report,it could be given only at a proper stage.

He said the time would be decided after the court’s decision over the report. Only after that the copy could be given to the applicant.

In the hour-long proceedings,Jamuar also read out a story by The Indian Express — “SIT probe documents highly sensitive,not for public view” published on March 15,2012,before Justice SM Vora.

After reading the whole story,he pointed out that the report which said that the SIT was afraid of handing over the report to Zakia Jafri as it could “open a Pandora’s box” was not true.

From Zakia’s lawyer Mihir Desai argued that according to the Supreme Court’s decision the concerned court (metro court) should give a copy of SIT report to the applicant before accepting or rejecting the investigation,the SIT has filed in its report.

Desai said his client doesn’t know anything about the contents of report and therefore she has the right to know what all the report contains. He said the copy of the report should be given.
