The Gujarat High Court on Tuesday issued a notice to the state government,while hearing a petition filed by the Gujarat Fair Price Shops License Holder Association (GFPSLHA) against a circular by the states food and civil supplies department.
GFPSLHA chairman Prahlad Modi,who is the elder brother of Chief Minister Narendra Modi,has filed a petition seeking cancellation of a circular issued by the department directing Fair Price shop-owners of the city to identify bogus ration card holders and report them to the authorities.
Claiming they are not legally empowered to decide if a ration card is authentic or bogus,the GFPSLHA has also challenged the provision that says any shop owner found not complying with the order would face penal consequences.
Following the petition,a single-judge bench of the HC comprising Justice Abhilasha Kumari issued notices to the respondents and kept further hearing on September 5. The respondents include the state government,food and civil supplies department,Ahmedabad district collector and others.
