400-page supplementary chargesheet filed against chairman in Ahmedabad’s Khyati Hospital PMJAY deaths

The Detection of Crime Branch (DCB) of Ahmedabad City Police on Tuesday said it has filed the supplementary chargesheet against Kartik Jasu Manilal Patel, the Chairman of Ahmedabad Bariatrics and Cosmetics Pvt Ltd, the holding company of Khyati Multispeciality Hospital where allegedly unnecessary angioplasty had resulted in the deaths of two PMJAY beneficiaries last year.

This chargesheet, filed in the Ahmedabad Rural Court in Navrangpura, comes 66 days after the DCB filed its initial chargesheet on February 7 against the eight other accused in the case related to the death of the two beneficiaries.
The supplementary chargesheet against Kartik Patel runs into 400 pages. Since the initial chargesheet filed against eight other accused was 5,670 pages long, the total length of the document is now 6,070 pages.

According to details from the DCB, the supplementary chargesheet includes 25 more statements apart from the 105 taken earlier, bringing the total to 130 statements. With the statement of a witness yet to be added, and seven submitted earlier under section 183 of the BNSS, the number of witness statements now totals to eight.

Evidence from one more electronic device brings the total number of such evidences to 20 while the addition of two more files brings the total to 38 files.
The Crime Branch stated that it has also included SOPs and documents from the PMJAY-MA scheme and those from Bajaj Allianz company, which is the insurer affiliated to the hybrid variant of the national health insurance scheme in Gujarat. Further, reports from the medical expert committee set up by the government to investigate the matter as well as hospital audit reports have been included in the chargesheet.

The report also includes the medical history of 37 patients and subsequent treatment given to them at UN Mehta Institute of Cardiology and Research Centre (UNMICRC), which had been submitted in the earlier chargesheet.

Residents of Borisana village of Kadi in Mehsana district, Mahesh Girdhar Barot (52) and Nagar Moti Senma (75) lost their lives on November 11, 2024, after undergoing what the health department’s expert committee called “completely unnecessary” angioplasty surgeries at Khyati Multispeciality Hospital in Ahmedabad.

While one FIR had been filed on behalf of the State, two were registered based on complaints from the families of the two deceased persons. Both these chargesheets have been filed in the FIR registered on behalf of the State.

Kartik Patel was the last of the nine accused to be arrested, being apprehended only on January 18, 2025 – 66 days after the cases were filed against him.

Before him, Director Rajshree Pradeep Kothari was arrested from Rajasthan on December 14, 2024, while Director Dr Sanjay Mulji Patolia was arrested on December 4, 2024, from Ahmedabad.

On November 26, 2024, the Crime Branch arrested Director Chirag Rajput and three members of the marketing team of the hospital including Milind Patel, Pratik Bhatt and Pankil Patel from a farmhouse in Kheda district of Gujarat. CEO Rahul Jain was arrested from Udaipur in Rajasthan by another team.

Dr Prashant Prakash Vazirani, the visiting Cardiologist who allegedly performed the surgeries, was the first to be arrested in this case on November 13, 2024, just hours after the three FIRs were filed.

In the case filed on behalf of the state, all nine accused were booked under Bharatiya Nyaya Sanhita (BNS) sections 105 (culpable homicide not amounting to murder), 110 (attempt to commit culpable homicide), 336(2) (forgery), 336(3) (forgery with intention to use it to cheat someone), 318 (cheating), 340(2) (knowingly using forged documents as genuine), and 61 (criminal conspiracy).
